Australian orders include GST where applicable.

Payment must be received in full before goods are dispatched.

Risk in the products passes to the customer upon delivery.

Customers assume all responsibility for drilling, mounting, fastening, adhesive application, cutting, or modification of any vessel, equipment, or accessories.

9. Marine Product Disclaimer

BerleyPro products are designed for marine and outdoor environments.

Marine conditions vary significantly and include exposure to:

  • Saltwater

  • UV radiation

  • Impact

  • Vibration

  • Weather

  • Abrasion

Products require reasonable inspection, maintenance, and care.

Failure to properly inspect or maintain products may result in reduced product life.

10. Fishing Line Disclaimer

Tasline and other fishing line products are subject to conditions beyond our control.

Fishing line performance can be affected by:

  • Abrasion

  • Impact damage

  • Rod setup

  • Environmental conditions

  • Fishing methods

No guarantee is provided against line failure resulting from these factors.

Customers are responsible for inspecting line regularly and replacing damaged line as required.

11. Limitation of Liability

To the maximum extent permitted by law, BerleyPro's liability is limited to:

  • Repair of the product;

  • Replacement of the product; or

  • Refund of the purchase price.

BerleyPro is not liable for:

  • Loss of profits

  • Loss of business

  • Loss of revenue

  • Loss of fishing opportunities

  • Loss of use

  • Property damage

  • Consequential loss

  • Indirect loss

  • Incidental damages

except where such liability cannot be excluded by law.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

Consumers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Consumers are also entitled to have goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.
